Overhanging Tree

Trees and vegetation on both public and private land contribute to the character and environment of our city. Responsibility for managing overhanging branches depends on where the tree is growing and where its branches are hanging over.

This section helps you identify your specific issue and directs you to the correct reporting stream. The Council is responsible for maintaining trees on public land (such as in streets and parks), while property owners are responsible for trees on their private land.

Tree and Vegetation Maintenance (Inc Storm Damage)

Devonport City Council manages the trees and vegetation on public land, including streets, parks, and reserves. This involves proactive maintenance like pruning and planting, as well as responding to urgent situations such as storm damage, to keep our community safe and green.

Urgent Hazards and Storm Damage

If a fallen tree or large branch is blocking a road or poses an immediate and serious risk to public safety, please call us immediately on (03) 6424 0511 (24 hours).

Request a New Tree

Street trees enhance our neighbourhoods, provide shade, and support local wildlife. Council undertakes a tree planting program to maintain and expand our city's urban forest.


The Assessment Process

Please note that submitting a request does not automatically guarantee a tree will be planted.


All requests are assessed by Council officers to ensure the location is suitable. The assessment considers factors such as:

  • Available growing space

  • Proximity to powerlines and underground services

  • Existing trees and overall streetscape

Clearing of Native Vegetation

The clearing of native vegetation, which includes trees, shrubs, and native grasslands, is a regulated activity in Tasmania. The removal of or damage to native vegetation is primarily assessed against the Devonport Local Provisions Schedule and the State-wide Tasmanian Planning Scheme.

In many cases, a planning permit is required from Council before you can begin any clearing works. Additional approvals from other state authorities may also be necessary depending on the scale and location of the proposal.


Before You Apply

The regulations regarding native vegetation are complex. They are designed to protect biodiversity, prevent land degradation, and conserve threatened species and ecosystems.

We strongly recommend that you discuss your proposal with a Council Planning Officer before undertaking any works or lodging an application. A planner can provide preliminary advice on what planning rules may apply to your property and what information would be required for an assessment.
