Environmental Legislation

Devonport City Council enforces pollution offences in accordance with Environmental Management and Pollution Control Act 1994.

Devonport City Council is the Appropriate Regulatory Authority (ARA) for Devonport businesses and residents except when:

Requirement to Notify a Pollution Incident

Pollution incidents that threaten or cause material harm to the environment are to be notified to the Environment Protection Authority Tasmania (EPA).

To report a pollution incident or to lodge a complaint, call the Pollution Incidents and Complaints Hotline on 1800 005 171.

Material harm includes incidents such as oil and chemical spills which present actual or potential harm to the health and safety of humans or the environment.

It is the duty of the person carrying out the activity, whether an employee or the occupier of a premises where the incident occurs, to notify the EPA. Failure to do so is an offence.
