Petitions

In accordance with S57(2) of the Local Government Act 1993 (“the Act”), a person may lodge a petition with Council.

“A person lodging a petition is to ensure that the petition contains –

  1. a clear and concise statement identifying the subject matter and the action requested; and
  2. in the case of a paper petition, a heading on each page indicating the subject matter; and
  3. in the case of a paper petition, a brief statement on each page of the subject matter and the action requested; and
  4. a statement specifying the number of signatories; and
  5. at the end of the petition –
    1. In the case of a paper petition, the full name, address and signature of the person lodging the petition; and
    2. In the case of an electronic petition, the full name and address of the person lodging the petition and a statement of the subject matter and the action requested, as set out at the beginning of the petition, has not been changed”.

Section 57(3) of the Act states:

Electronic petition means a petition where the petition is created and circulated electronically, and the signatories have added their details by electronic means.

Paper petition means a petition where the petition is created on paper which is then circulated and to which signatories have added their details directly onto the paper.

Changes made to the Local Government Act 1993 through the Local Government Amendment (Targeted Review) Bill 2017, have allowed for the submission of electronic petitions.

The Bill amends S57 to ensure the Act is more contemporary to accommodate online or electronic petitions by prescribing the requirements for petitions that are created in hard copy of electronically online.

Petition Guidelines

Petition Guidelines and Prescribed Petition form (for hard copy petitions), have been developed for Council.

The Guidelines provide prospective petitioners with a framework regarding the development of petition and prescribed directives in accordance with the Act.

These Guidelines will assist petitioners in ensuring their petition is in the prescribed form and valid under the Act.  It also details the lodging and tabling of a petition.
